That Viral Coldplay Kiss Cam: Can the CEO Really Sue?

A recent Coldplay concert in Massachusetts turned into a major social media story when Astronomer CEO Andy Byron and an employee, Kristin Cabot, were caught in an intimate moment on the Jumbotron. The video instantly went viral, leading to Byron’s resignation.

Astronomer swiftly released a statement confirming Byron’s departure and reinforcing their company values. With the CEO out of a job due to a very public gaffe, some online users wondered if he could take legal action against the band.

However, legal experts say it’s highly unlikely. Attorney Ron Zambrano points out that Byron has no legal basis for a lawsuit. Such a case would be seen as an attempt to stifle Coldplay’s artistic freedom. He also highlights that by being affectionate in public, Byron and Cabot gave up their right to privacy; they were simply caught on camera.

Civil attorney Tre Lovell agrees, stating that individuals have no expectation of privacy for their actions in public. While there are rules against using someone’s image for profit or defamation, neither applies in this situation. It seems this viral moment, though costly for Byron’s career, won’t lead to a legal battle with Coldplay.
